By entering the premises of Bark N Play, you (the "Owner") acknowledge and agree to the terms and conditions outlined in this waiver and release of liability agreement ("Agreement"). This waiver is intended to protect Bark N Play, its owners, staff, agents and affiliates from any liability arising from the use of the facilities by you and your dog(s).

 

1. Acknowledgement of Risk

You acknowledge and accept that by entering Bark N Play, your dog(s) will be engaging in physical activities that may involve risks of injury, illness or death. These risks may include, but are not limited to, accidents, falls, collisions with other dogs or objects and dog-related injuries. You understand that Bark N Play cannot guarantee the safety of any dog while in the facility.

 

2. Dog Health and Behaviour

You confirm that your dog is in good health, up to date on vaccinations and free from any contagious diseases or parasites. You confirm that your dog is not aggressive, is social with other dogs and will not cause harm to other dogs or people in the facility. You agree to supervise your dog while using the facilities and never leave them alone.

 

3. Owner Responsibilities

You are solely responsible for the behaviour of your dog(s) while in the facility. You must ensure your dog is always under control and cannot escape from the play area. You must remove your dog from the play area immediately if it becomes aggressive or poses a risk to others. You must ensure that your dog does not engage in dangerous behaviour such as excessive jumping, running into obstacles or inappropriate interactions with other dogs or people. You agree to clean up after your dog, using the available cleaning products around the facility and disposing of any waste in the provided bins.

 

4. Emergency and First Aid

In the event of an emergency, you grant Bark N Play permission to contact a veterinarian on your behalf, should the need arise, and you agree to cover all veterinary costs associated with your dog's care.

 

5. Liability Release

By reading and agreeing to this waiver and entering and using the centre, you, on behalf of yourself and any other persons accompanying you, hereby release, waive and discharge Bark N Play, its owners, employees, contractors and agents from any and all liability, claims, or demands for injury, death, damage, or loss caused by the actions or inactions of your dog or any other dog in the facility, including but not limited to injuries arising from accidents, falls, bites or dog-to-dog altercations.

 

6. Indemnification

You agree to indemnify and hold harmless Bark N Play from any claims, damages, or expenses (including legal fees) arising from your dog’s behaviour, actions, or any injuries caused during the use of the facility.

 

7. Acknowledgement of Self-Service Facility

You acknowledge that Bark N Play is a self-service facility, that staff are not always present, and you agree to supervise your dog at all times. You are solely responsible for the supervision and well-being of your dog while in the facility.

 

8. Personal Property

You agree that Bark N Play is not responsible for any loss, theft, or damage to your personal belongings, including collars, leashes, or other items brought into the facility.

 

9. Photography and Videography

You agree that Bark N Play may take photographs or videos of your dog during its visit and may use these images for promotional or marketing purposes. If you do not wish for your dog to be photographed, please inform us before entering.

 

10. Termination of Access

Bark N Play reserves the right to refuse or terminate access to the facility if your dog’s behaviour poses a threat to others or if you fail to comply with the rules and regulations of the facility.

 

By proceeding with your booking, you acknowledge and accept the terms of this Waiver and Release of Liability Agreement.
